For the first time in tri-city, a Mohali court awarded 6-month jail time to a woman who was found guilty of negligence after her pet dog bit her neighbor in April 2018.
The court also imposed a fine of INR 1500 on the convict Minakshi, who is a resident at Phase 10 Mohali. She lives on rent and runs a beauty parlor. She applied for bail and granted by the court. She plans to file an appeal against the verdict.
According to the court order, Minakshi was negligent in keeping a check on her pet dog. The dog wasn’t leashed outside which resulted in the dog biting the neighbor.
The case was registered by the complainant and now the Minakshi has been convicted by the court under sections 289 (negligent conduct with respect to animal) and 337 (causing hurt by act endangering life or personal safety of others) of the IPC (Indian Penal Code).
The complainant registered a complaint against Minakshi at the Phase 11 police station on April 21, 2018. Minakshi is now alleging that Rashpal (the complainant) has been bitten by a stray dog and she has been falsely accused to get her out of the rented accommodation.
She alleges that Rashpal had been trying to get her to vacate the accommodation even when she has rent agreement with him. She also argued that the police did not verify whether the bite was from her dog or from a stray dog.
She also sought leniency on the grounds that her husband is working in some other city, her daughter is about to get married and her son is still studying. She has home loans to pay as well.
However, the victim’s statement and doctor’s observation which said that it was her pet dog that bit Rashpal, resulted in her conviction.
